What the Business Owner/Manager Must Know About The DUI Laws and Processes

Pulled over for DUI

Last time, we discussed how the Business Owner should understand what his employee may be going through when accused of a crime. Now we should discuss the more specific crime of Driving Under the Influence(DUI) and how this allegation affects your employees.

What the Business Owner/Manager Must Know About the Criminal Law

Employment Law

When you have an employee (or family member, friend or acquaintance for that matter) who is charged with a crime, what can/should you know?

Many of us have no idea what it can be like being charged with a crime. In my Simple Tip Number 2 on the topic of “Process” (Yes, go back and read my two part piece on this critical area of the law.), we discussed how Process seems to be more than 50% of what we do in the law. At times, the criminal law is no different on this essential need to understand its processes.

Downsizing Your Company: Continued

Company Downsizing

Downsizing a company is never an easy thing. And to add to the stress some terminated employees try to state that you or some other superior made comments about the former employee’s age, gender, race, religion, disability, etc. However, please understand that another way these disgruntled ex-employees attempt to position their wrongful termination claims (yes, I know speaking through their…. Lawyer) is through the consequential effect of the down sized company. Let me explain with a possible example.

DO YOU NEED TO DOWN SIZE? WHAT DO YOU NEED TO KNOW?

~~For many business owners, there comes a time when downsizing should be considered.
Yet, the term “downsizing” can take many forms and mean different ideas in different situations.
Let us start with the first and usually most important “downsizing” topic:   Employees?
ACTUALLY NO!
1. Your first topic involves YOUR ORGANIC DOCUMENTS!  What are my organic documents?

ARE YOU READY TO EXPAND? WHAT DO YOU NEED TO KNOW?

~~For most business owners and managers, the realization that expansion is necessary whacks us in the face!

WHEN ARE GOOD TIMES TO SCHEDULE SESSIONS WITH MY HATED LAWYER?

WHEN ARE GOOD TIMES TO SCHEDULE SESSIONS WITH
MY HATED LAWYER?

Can the lawyer business be seasonal?   In many experiences, yes!

Judges take vacations.  Court staffs take vacations. Lawyers take vacations. Many are family people.  Sooo….  Most of them arrange summer, holiday and Spring Break vacations.  Conventions are routinely scheduled in the summer.  The Idaho State Bar Convention is always held in the summer.

CAN EVEN YOUR HATED LAWYER SET UP HIS OWN BUSINESS?

After 23 years with the same law firm, I finally branched out and established my own law firm; David Hammerquist Law Chartered.  Having given advice on establishing businesses for almost three decades, it was finally my turn to see if I have known what I was talking about?   Did I?    WELL…..  Mostly.

            Where was I correct?

Correctly, I knew that everything about the move and transition would take longer and try one’s patience and energy more than what one would be inclined to naturally believe.

WHY YOU CARE ABOUT THE BUSINESS LESSONS EXPERIENCED ON THE WAY TO AND FROM AND DURING THE BUSINESS SECTION OF THE AMERICAN BAR ASSOCIATION’S 2013 LEADERSHIP CONFERENCE IN CHICAGO.

~~The Business Lessons learned from and for the American Bar Association Leader’s Conference began long before the conference.
To attend, I had to coordinate many complexities through the American Bar Association and my local Governing Council. Despite these two entities’ resources, I was required to arrange my own lodging and flights. I also expended considerable time booking recreational time as the flight schedules did not allow me to merely run out and back.

SKEET

The Idaho State Bar Association’s Business and Corporate Section’s Governing Council meets at least nine times per year. Although competitors, our members share information about trends in the law and other information designed to help our clients in their business pursuits. We also participate in frequent presentations from experts in various business and corporate fields, not just in law. Typically, we receive legislative updates and insights.
